3. OWNER’S REPRESENTATION
3.1 Owner states that he/she has the ownership of the Vehicle.
3.2 Owner states that to the best of his/her knowledge and belief that above-described vehicle is in normal condition.
3.3 Owner will provide Renter a copy of the insurance policy for Renter’s review.

4. RENTER’S REPRESENTATION AND COVENANT
4.1 Renter states that he/she and the permitted driver(s) is physically and legally qualified to operate the above-described vehicle. Renter states that he/she and the permitted driver(s) have sufficient skills and experience to drive the Vehicle for this planned trip.
4.2 Renter will not create any kind of lien, mortgage, or any kind of security interest on the Vehicle.

5. RENT
5.1 Rental rates are based on the Vehicle Rental Rate sheet in appendix.
5.2 Owner will bear any income tax for the rent.

6. DURATION
The rental period shall be from to Noon. Renter must return the Vehicle to: Shell Gas Station-3204 Richards RD, Bellevue, WA 98005 in the RV parking lot section, on the date and time specified in this Agreement, and in the same condition that Renter received it, except for ordinary wear. If the Vehicle is returned after closing hours, Renter remains responsible for the safety of, and any damage to, the Vehicle until Owner inspects it upon Owner’s next opening for business.

7. CHARGES
Renter agrees to pay Owner based on the attached Rental Rate sheet, or the appropriate government authorities, upon Owner’s demand for all charges due to Owner under this Agreement, including but not limited to:
a) Time and mileage for the period during which Renter keeps the Vehicle or a mileage charged based on our experience if the odometer or its seal is damaged, tampered with / or disconnected.
b) Charges for optional products or services Renter elects to purchase.
c) Fuel and/or Propane, if Renter returns the Vehicle with less fuel than when rented.
d) Loss of, or damage to, the Vehicle which includes the cost of repair, or the actual cash value of the Vehicle based on valuation methods accepted by the auto insurance industry on the date of the loss if the Vehicle is not repairable, or if Owner elect not to repair the Vehicle, plus an administrative expense incurred in processing the claim.
e) Cleaning cost if the Vehicle is not returned in the same condition rented.
f) Dumping of the Black or Grey tanks.
g) Actual expenses incurred to Owner in locating and recovering the Vehicle if Renter fails to return it or Owner elects to repossess the Vehicle under the terms of this Agreement.
h) Any unpaid traffic tickets or toll fees incurred while in renter’s rental period

8. PURPOSE OF USE
Renter shall use the Vehicle for personal ordinary use. The Vehicle shall not be used to:
*carry passengers or property for hire;
*carry passengers in excess of the capacity set forth above;
*carry passengers, goods or materials in excess of the rated weight carrying capacity of the vehicle as set forth above;
*carry passengers other than in the interior or cab of the vehicle;
*push, propel or tow another vehicle, trailer or any other thing without the written permission of Owner.
The Vehicle shall not be:
*used for any race or in any competition;
*used for any illegal purpose;
*operated by any other person other than the Renter set forth above without the written permission of the Owner.
*The Renter shall not operate the vehicle in a negligent manner.

9. SECURITY DEPOSIT
A security deposit is held in the amount of $1,000 dollars. The owner may use the deposit to pay any amounts owed to Owner under this agreement, including but not limited to the loss or damage to the Vehicle or equipment, or any repair or replacement of the component. If the amount of the security deposit is insufficient to satisfy all amounts due then the Renter agrees to pay all charges in excess, either by personal check or authorized use of the credit card provided. In the absence of damage or loss, said deposit shall be credited toward payment of Rental Rate and any excess shall be returned to Renter.

10. RENTAL, INDEMNITY, AND WARRANTIES
10.1 This Agreement is a contract for the rental of the Vehicle. The owner may repossess the Vehicle at Renter’s expense without notice to Renter if the Vehicle is abandoned, used in violation of law, or used in violation of this Agreement.
10.2 Renter agrees to indemnify Owner, defend Owner and hold Owner harmless from all claims, liability, cost and attorney fees incurred by Owner resulting from or arising out of, this rental and Renter’s use of the Vehicle.
10.3 Owner makes no warranties, express, implied or apparent regarding the Vehicle, no warranty of merchantability, and no warranty that the vehicle is fit for a particular purpose.

11. LIABILITY INSURANCE
Renter is responsible for all damage or loss Renter caused to others. The owner has MBA commercial insurance which automatically covers renter at $25,000/50,000/10,000 for Bodily Injury (PER PERSON)/Bodily Injury (PER ACCIDENT)/Property damage. The renter also has the option to obtain an insurance binder from his/her own auto insurance company for liability, collision and comprehensive insurance covering Renter, Owner, and vehicle. Deductible for Comprehensive: $1,000. Deductible for Collision: $1,000. Deductible for Medical Payments: $2,000 Per Person. Deductible for UIM: Per State Requirement.

12. RESPONSIBILITY FOR DAMAGE OR LOSS; REPORTING TO POLICE
12.1 Renter hereby agrees that he / she shall be held fully responsible for any and all loss of or damage to the Vehicle or equipment during the term of this Agreement whether caused by collision, fire, flood, vandalism, theft or any other cause, except that which shall be determined to be caused by a fault or defect of the Vehicle or equipment.
12.2 Renter must report all accidents or incidents of theft or vandalism to the police as soon as Renter discovers them. Renter must report all accidents involving the Vehicle to us within 24 hours of occurrence.

13. RENTER’S PERSONAL PROPERTY
13.1 Renter releases Owner from all claims for loss of, or damages to, Renter’s personal property or that of any other person, that was left or carried in Vehicle.

14. CONDITION OF VEHICLE
14.1 Owner shall provide the Vehicle in clean and operating condition.
14.2 Service to the Vehicle or replacement of parts during the rental must have Owner’s prior written approval.
14.3 Renter must check and maintain all fluid levels and tire air pressure during the rental period.

15. DRIVING RESTRICTIONS
The Vehicle shall not be driven outside the Continental United States or Canada. The Vehicle shall only be driven on paved roads.

16. PETS
No pets shall be allowed in the Vehicle. Failure to comply with this requirement will result in loss of Security Deposit plus cost of cleanup.

17. SMOKING
No smoking is allowed in the Vehicle. Failure to comply with this requirement will result in loss of Security Deposit plus cost of cleanup.

18. TOWING
The Vehicle is not allowed to tow any other vehicle or trailer.

19. DRIVER REQUIREMENTS
The Vehicle can only be driven by an authorized driver 25 years of age or older possessing a valid and identifiable driver’s license. All drivers must be covered by the Renter’s insurance and will be bound by the terms and conditions of this rental agreement.

20. OCCUPANTS
Only the drivers and passengers listed on the Driver & Passenger List sheet are allowed to travel in the Vehicle.

21. JURISDICTION
The parties consent to the jurisdiction of Washington State. This Agreement shall be governed by the laws of Washington State without reference to principles of conflicts of laws.
