RENTAL AGREEMENT

PLEASE CAREFULLY READ THIS!

For multiple day rentals, the Watercraft shall only be driven from dawn to dusk and is not to be driven at night. It is the responsibility of the LESSEE to ensure there is ample time to return before it becomes dark.
The Watercraft shall only be used on Lake Keowee and should not be removed from the lake at any time.
LESSEE agrees to return the Watercraft at the designated time within this contract. Late fees will apply at the prorated rate of $150 per hour if the Watercraft is not returned at the designated return time. LESSEE agrees to call LESSOR immediately if the Watercraft will not be back at the designated time.
It is understood that there may be times where the Watercraft cannot and should not be used due to adverse weather conditions.

LESSEE is responsible for any gas aside from the full tank provided at the beginning of the rental for the duration of their rental. For boat rentals, gas shall be refilled by the LESSOR at the end of the rental period, covered under the gas refill fee assessed at the time of rental. LESSEE will be charged the corresponding amount for gas upon return of Waverunner.

It is extremely important that the Watercraft shall be driven with “no wake” when coming in and out of a narrow cove area, at the pickup dock and/or other areas where no wake is designated or expected.
Avoid reefs, rocks and shallow areas being aware of signs and buoys which may designate these areas.
Thunderstorms are a regular occurrence at Lake Keowee and oftentimes roll-in during the afternoons. The weather can move in very quickly on Lake Keowee and may be very harsh. Please return at the first sign of adverse weather moving in and do not wait until it arrives, which at that point is too late.
Lake Keowee is a very large lake with many coves and inlets. Keep track of the direction you are heading and landmarks to ensure you can find your way back.
Discount codes are to be used for their intended purpose. Abuse or exploiting codes will result in the code being removed and correct amount charged, including and up to 30 days after your reservation date.



LESSEE agrees to wash off feet and/or other sources of dirt and debris prior to re-entering the boat. All belongings and trash shall be removed by the LESSEE at the end of the rental period. Any excessive dirt (i.e. red clay), debris and/or trash left within the boat upon return will incur a cleaning charge of $75.
If the boat is used for waterskiing, or any other activities which require someone to be pulled from behind the boat, there must be an experienced driver for these purposes, of at least 21 years of age, driving the boat and an additional “spotter” to observe the person and report to the driver.

- The boat shall be driven with “no wake” when coming in and out of narrow cove areas and/or other areas where no wake is designated or expected.

- The boat will be parked to the side or within a sanctioned dock by Duke Power, be securely tied up and be fully protected with buoys so the boat never makes contact with the dock.
Avoid reefs, rocks and shallow areas (there is a depth finder on the boat that should be monitored at all times), being aware of signs and buoys which may designate these areas or noting discoloration of the water (i.e. Red Carolina Clay) indicating shallow areas.

Please return at the first sign of adverse weather moving in and do not wait until it arrives, which at that point is too late. Typically, such adverse weather will move in and out fairly rapidly, and there will be time to return to the lake.
Lake Keowee is a very large lake with many coves and inlets. Keep track of the direction you are heading and landmarks to ensure you can find your way back. It is recommended to carry a cellphone with GPS to assist with navigation.

- Always make sure everyone aboard the boat has a personal floatation device that properly fits.

- Do not come within 200 feet of another watercraft or dock when operating the boat beyond “no wake” speed.

- Never attempt to jump the wake of another watercraft.

- The following operating and safety rules are by no means an exhaustive list, but important enough to mention while using the boat.

- Always shut the engine completely off before allowing anyone to enter or exit from the back of the boat.

- Never allow anyone in the water near the propeller at any time.

- Always perform a head count to ensure all passengers are on the boat before starting the engine.





- NO tubes, waterskiiers or anything whatsoever will be towed by any Waverunner.
- The intake for the water on the bottom of the Waverunner is extremely powerful. Operating the Waverunner in shallow areas should be avoided. If any foreign objects (i.e. ropes, fishing line, sticks, rocks, sand…etc) are sucked into the Waverunner during the time of rental, it will be the sole responsibility of the LESSEE to cover the cost of the removal of the foreign object(s) and any repairs required to the Waverunner as a result of damage caused by the ingestion of such foreign object(s). There would be no reimbursement for lost rental time for ingestion of foreign object(s) causing breakdown. Determination of mechanical failure due to ingestion of a foreign object(s) shall be made by a qualified mechanic upon inspection of the Waverunner.

- For multiple day rentals, the Waverunner will be parked at a dock before dark and shall only be used between dawn and dusk. It should be placed on a proper Waverunner lift/ramp or secured and completely protected with bumpers to insure it does not bang against a dock or other objects. It is agreed LESSEE will ensure that the WaveRunner never comes in contact with a dock and any damage caused by contact with any dock will be charged to the LESSEE.

- Never “beach” the Waverunner. You can anchor a Waverunner and wade to the beach. Do not drive the Waverunner in shallow areas where sand/dirt can be ingested into the engine.
Always maintain at least 200 feet distance from other boats, Waverunners or other watercraft. ABSOLUTELY NEVER jump the wake of other watercraft within 200 feet of said watercraft.

NOTE: LESSEE agrees that LESSOR will have the right to repossess the Watercraft if LESSOR or any other parties the LESSEE has allowed to operate the Waverunner are observed violating any of the provisions of this contract or operating the craft in an unsafe manner. No reimbursement for time lost will be provided to the LESSEE if this were to occur.

In consideration of the agreement herein, LESSOR does lease to the undersigned LESSEE the Watercraft and equipment described herein. LESSEE agrees said Watercraft will not be occupied by greater than the maximum Watercraft capacity allowed (3 people for Jet Skis, 10 - 12 for specific boats). LESSEE agrees to report any accident, malfunction, or breakdown of rental Watercraft to LESSOR immediately in accordance with paragraph (6) under general rules. This is to certify that LESSEE, and anyone he/she allows to use the Watercraft, is/are experienced and capable in all aspects of the handling and operation of a Watercraft such as the one being rented. I have read all pages of this agreement and fully understand the terms and conditions as set forth on all pages; that I acknowledge receipt of a copy of this agreement.

I acknowledge that operation or use of a watercraft has inherent risk that may lead to bodily injury or death. I further understand that I am not bound to or required to participate in any of the activities presented to me, but have willingly and voluntarily decided to participate. I have no health restrictions which would prevent me from participation in any activities or entering into this agreement. I realize that I am free to refuse to participate in any or all activities including those I feel uncomfortable with or which I feel cannot be completed safely by me. I knowingly and voluntarily assume all risk of injury, illness, damage or loss, both known and unknown associated with the rental operation or use of the Watercraft or associated rental equipment, even if arising from the negligence, act, or omission of rental LESSOR and assume full responsibility for my participation.

THE TERMS AND CONDITIONS HEREIN CONTAINS THE ENTIRE UNDERSTANDING BETWEEN LESSEE AND LESSOR AND THAT NO OTHER REPRESENTATION OR INDUCEMENT, ORAL OR WRITTEN, HAS BEEN MADE, WHICH IS NOT INCLUDED IN THIS RENTAL AGREEMENT.
